Nelson Elder Care Law explains how the new T.O.D.D. option helps homeowners avoid probate
Georgia residents now have a new option for streamlining their estate plans with the introduction of Transfer on Death Deeds (T.O.D.D.), which became available in July 2024. This legal tool allows homeowners to transfer real estate directly to a designated beneficiary without the need for probate, offering a more efficient way to pass on property.
Josh Nelson, owner and attorney at Nelson Elder Care Law, explains the significance of this new law: “T.O.D.D. is an exciting development for Georgia homeowners. It provides a simple way to ensure your property is transferred to your loved ones without the delays and costs of probate.”
A Transfer on Death Deed works by allowing the property owner to name a beneficiary who will automatically inherit the property upon the owner’s death. Until that time, the owner retains full control over the property, including the ability to sell or mortgage it.
Nelson Elder Care Law encourages homeowners to consider this new tool in their estate planning but emphasizes that T.O.D.D. is just one piece of the puzzle and may not be the best choice for everyone. “For comprehensive asset protection, an Absolute Protection Trust™ remains the best option. We help families of all ages identify their estate goals, understand the legal tools available, and create a plan that meets their unique needs,” said Nelson.
